Are Online & Electronic Wills Legal in Yukon?

These two terms get blurred, but in Yukon they lead to different outcomes. An "online will" is fine; a fully "electronic will" is not.
Three labels
- Online will — drafted on a website, then printed and signed on paper. Valid in Yukon.
- Electronic will — e-signed and stored digitally, never printed. Not valid in Yukon.
- Digital will — a catch-all that covers both.
Online wills: yes, on paper
Using an online service to draft your Yukon will is completely fine. The platform asks about your circumstances and produces a Yukon-compliant document. To make it legal you must print it and sign it before two witnesses who are not beneficiaries (or sign a fully handwritten holograph version). The convenience is the drafting; execution stays on paper.
Electronic wills: not in Yukon
Unlike British Columbia — the only Canadian province that currently recognizes fully electronic wills under its Wills, Estates and Succession Act — Yukon still requires a physical signed original. A will that exists only as a PDF with e-signatures, stored in the cloud, isn't valid here. The same goes for video or audio recordings of your wishes.
What "properly executed" looks like in Yukon
- Print the final will.
- Sign at the end in front of two adult witnesses.
- Both witnesses sign in your presence and in each other's presence.
- Neither witness — nor their spouse — should be a beneficiary.
- Store the original somewhere safe; tell your executor where it is.
Remote witnessing
Pandemic-era remote witnessing rules in most provinces have either expired or been narrowed. Assume you and your witnesses must be physically present in Yukon unless a current statute says otherwise.
