Is a Handwritten (Holograph) Will Legal in Quebec?
Last updated 2026-06 · Quebec
Yes. The holograph will is one of the three forms of will the Civil Code of Québec expressly recognizes. If you write your will out by hand and sign it, it is valid — no notary, no witnesses required.
What makes a Quebec holograph will valid
The Civil Code asks for very little:
- the will must be written entirely in your own hand; and
- it must be signed by you.
No witnesses, no notary. Handwriting throughout the document is treated as proof it genuinely came from you.
The catch: verification after death
Unlike a notarial will — which a notary stores and which needs no further step — a holograph will must be verified ("probated") by the Superior Court or a notary after you die, to confirm it's genuinely yours. That adds a little time and a modest fee for your liquidator before they can act. A notarial will skips this entirely, which is its main advantage.
The partly-typed trap
The most common failure is mixing handwriting with typing — for instance, filling handwritten answers into a printed form. Because it isn't entirely handwritten, it won't qualify as a holograph will. If part of your document is typed, it must instead meet the rules for a witnessed will (signed before two witnesses).
Why holograph wills carry risk
They're valid, but they're the form most likely to cause problems: handwriting and meaning can be disputed, and home-made wills often miss key elements — naming a liquidator, alternate heirs, or how the residue is shared. Gaps can send part of the estate into the Civil Code's default rules. Treat a holograph will as a useful stopgap, not a permanent plan.
When it makes sense
A holograph will is a sound emergency measure — a sudden illness, no existing will. Afterward, consider a notarial will for certainty and easier administration.
Frequently asked questions
Does a handwritten will need to be witnessed in Quebec? No — a holograph will needs no witnesses, only your handwriting and signature. Is a holograph will valid in Quebec? Yes, if it is entirely handwritten and signed; it must be verified after death. Can a will be typed and still be valid in Quebec? Yes, as a witnessed will signed before two witnesses, or as a notarial will. Are handwritten wills easy to contest? They're more vulnerable than notarial wills, and they always require verification before the liquidator can act.
