Is a Handwritten Will Legal in Alberta?

Last updated 2026-06 · Alberta

Yes — Alberta recognizes the holograph will. If you write your will out entirely by hand and sign it, it's valid even with no witnesses present. It's the simplest legal will available in the province, and a genuine option in a pinch.

What makes a holograph will valid in Alberta

Under the Wills and Succession Act, a holograph will must be:

  • entirely in your own handwriting; and
  • signed by you.

That's all the law demands — no witnesses, no notary. The reasoning is that your handwriting throughout the document is itself strong evidence it's authentically yours.

The partly-typed trap

The usual way these fail is the printed will kit: a typed form with a few handwritten blanks. Because it isn't wholly in your handwriting, it generally won't pass as a holograph will — and if it wasn't witnessed properly either, it can fail entirely. If you're using a printed template, treat it as a formal will and have two people witness it.

Why holograph wills invite trouble

Valid doesn't mean trouble-free. Handwritten wills are the most contested form because handwriting and meaning can be argued over, and because they routinely omit essentials — alternate executors, what happens if a beneficiary dies first, guardianship, a residue clause — leaving gaps that fall into intestacy. They're best treated as an emergency measure.

When it makes sense

A holograph will is a reasonable stopgap during a sudden health crisis with no other will in place. Once things settle, replace it with a properly witnessed or professionally drafted will.
